COMERCIALIZADORA DE GRANOS LOS ARBOLITOS S.A. DE C.V. (hereinafter referred to as “LOS ARBOLITOS”), based on articles 15 , 16, 17 and other related articles of the Federal Law on Protection of Personal Data held by Private Parties (hereinafter the "Law"),offers this Privacy Notice, under personal data that is to collect from You as owner thereof (hereinafter the "Holder" )

I. Identity and address of the responsible.

COMERCIALIZADORA DE GRANOS LOS ARBOLITOS S.A. DE C.V. indicates the address in order to fully comply with the obligations arising from the law, is the domicile located in Carretera Guamúchil-Angostura, Km. 7.1 s/n, Angostura, Sinaloa.

To us, the confidentiality and security of personal data is a priority, which is why, you can rest assured that your information will be handled under the principles of quality, legality, confidentiality, transparency, temporality, security, fidelity and purpose, as well as in the terms stated in the LFPDPPP. (Federal Law on Protection of Personal Data).

PURPOSE OF YOUR PERSONAL INFORMATION.

I. Clients.

We inform you that any personal data from You , including sensitive data, that currently or in the future is held in our database, will be processed and/or used by LOS ARBOLITOS , and/or third parties which by the nature of their work or functions have the need to treat and/or use your personal data; with the purpose of providing services and/or products you have requested and to fulfill those obligations arising from the legal relationship between You as owner of the personal data and LOS ARBOLITOS.

Furthermore, (1) provide the services and products required by You; (2) report changes of new products or services related to the already existing legal nexus; (3) comply with obligations to You; (4) The negotiation, start, implementation, maintenance and termination of the legal relationship between the Client and the Holder, (5) The operation, management, administration, benefit, expansion of services provided to the Client. (6) Notify you about the varied services and products by LOS ARBOLITOS through sending brochures, promotions, pamphlets, etc.; (7) integrate your file as a client; (8) as well as the preparation of surveys on our services; (9) video recording and CCTV for supervision or monitoring due to safety issues. The images are kept for a certain period and then deleted, without keeping backup of any kind. 

II. Employees.

( 1) For the existence, maintenance and enforcement of the legal relationship, whether existing or possible with You; (2) access to our facilitites; (3) the process of recruitment, evaluation, selection, placement and/or job positions linking required by LOS ARBOLITOS  (4) conducting of socio-economic and/or psychometric studies; (5) for the initiation and maintenance of the working relationship; skills development and training; payment of wages, performance of services related to employment, fiscal and social secutiry; granting of benefits, discounts and promotions (6); perform internal studies on performance and job descriptions. 

III. Suppliers (individuals) and/or legal representative:

Establish, monitor and maintain contractual relationships with LOS ARBOLITOS; or to comply with tax and payment obligations derived from our relationship as suppliers; or give attention to inquiries and/or exercise of rights of access, rectification or objection regarding personal data you make.

In addition, carry out factoring activities, or request quotes, technical clarifications and information of their products in order to conduct a supplying transaction.
To fulfill these purposes, we can collect your personal data in different ways: when you provide them directly to us and when we get information through other physical or electronic sources, which are permitted by law. The following are the personal data we collect directly:

CLIENTS.- Full name, Federal Taxpayers Registry (RFC), Unique Population Registry Code (CURP), tax and/or private domicile, landline and/or mobile number, e-mail, legal representative personal data, if any.

EMPLOYEES.- Name, birth certificate, address, landline number, mobile number, IFE voting card number, Unique Population Registry Code (CURP), photograph, academic background, degrees,  professional license, certificates, academic recommendations, e-mail, Federal Taxpayers Registry (RFC), tax domicile, social security number, statement of tax withholdings (W-2 Form), employment references, job application form, information contained in employment contracts, work incidents, training, assessments results, social security number, employment references, personal references, psychometric assessments of intelligence and personality, bank account number, Bank account number and bank name , CLABE (Standardized Bank Key). 

SUPPLIERS.- (natural persons and/or legal representatives): Name, business address, landline number, Unique Population Registry Code (CURP), e-mail, web page address, Federal Taxpayers Registry (RFC), tax domicile, bank account number and name of bank, CLABE number (Standardized Bank Key), product literature, catalogues, and/ or brochures.

Such personal data are provided by the owner in a free and voluntary way to LOS ARBOLITOS. In the case that you do not want your personal data to remain in our systems of personal data, you can send an email at [email protected] in order to be discharged from these, however , it is important to point out that these will remain in our systems until actions that may arise from our relationship with You become extinct.

STORAGE OF PERSONAL DATA. In case you oppose to this storage, we would like to inform you that your information will be kept on guard in our files, for a period of 5 years maximum, in order to comply with the legal and/or fiscal actions that might arise from our relationship.

PERSONAL DATA TRANSFERENCE. We transfer personal data to: in the case of clients, to state authorities, Tax Administration Service (SAT), accounting advisors and external auditors, credit bureaus, in the case of suppliers, we share their brochures and catalogues with the clients of LOS ARBOLITOS. Furthermore, your contact data, exclusively, can be shared with the courier service to send you information concerning the business relationship you maintain with LOS ARBOLITOS.

As of employees, LOS ARBOLITOS will be able to share your personal data on account of social welfare and fringe benefits granted to third parties by LOS ARBOLITOS, such as external auditors, IMMS, INFONAVIT, FONACOT, banking institutions, consulates and/or Ministry of Foreign Affairs, etc. Insurance companies, uniform suppliers, companies that administer food and/or gasoline allowance vouchers, savings bank, unions, to the extent that the law permits, who are required and must address their own privacy laws regarding their data.

If you do not express your opposition to your personal data being transferred, it is understood that you have granted your consent to do so.

SUPERVISORY ORGAN.

If you believe that your right to the protection of your personal data has been           infringed by conduct or omission on our part, or presume any violation to the dispositions laid down by the Federal Law on Protection of Personal Data, its rules of procedure, and other applicable regulations, you may bring your dissatisfaction or complaint before the Federal Institute of Access to Information and Data Protection (IFAI). ARCO RIGHTS. The holder of personal data at all moments, and in the terms of  LFPDPPP (Federal Law on Protection of Personal Data), will be able to exercise the access rights, rectification, cancellation and objection (ARCO rights), concerning your personal data which is being processed in any of the personal data systems;  from the foregoing, the applicant must:

1. 1.- Submit your application physically at the address given at the beginning of this notice, or by e-mail at [email protected] being Ms. Juana López Díaz the person in charge of our Privacy Department.
   The format of 'ARCO Rights Request' is available on our Web Portal www.losarbolitos.com.mx; or at our office located in Carretera Guamúchil - Angostura, Km . 7.1 s/n, Angostura, Sinaloa.
2. The application ( physical or electronic ) of access, rectification , cancellation and objection must indicate:
   1. Name of the guardian or legal guardian, or name of the holder of personal data.
   2. The domicile or electronic means to communicate the answer to your request.
   3. Where appropriate, the name of the legal representative or attorney.
   4. What right is being exercised? That is, if it is the right of access, rectification, cancellation, or objection.
   5. The clear and precise description of the personal data on those seeking to exercise any of the rights mentioned in the previous point.
   6. If it is the right of rectification, you must indicate at least, the personal data you wish to correct or update.
   7. In the case of the right of cancellation or objection you must indicate at least, the personal data on which you exercise these rights.
   8. Also, you must indicate any element or document which facilitate the location of your personal data.
   9. The way the information is required: plain copy, electronic document or any other means.
3. As this is a personal right , if your intent is to exercise the ARCO rights on                information of a minor, you must prove your personality (through the current voting card issued by the Federal Electoral Institute , or    passport, or valid Visa or Professional License) and the tutelage (through the birth certificate or court decision).
4. In the event that you are an adult and want to exercise the ARCO rights, you must prove your personality through a valid IFE voting card, issued by the Federal Electoral Institute, passport, Professional License, or military ID.
5. The accreditation of personality or representation shall be made ​​at the time the response that resulted in your application is collected.
6. The notification that a response to your request has been issued will be sent through the means indicated to do so.
7. The dealine we have to issue a response to your request, is 20 days from its reception, in the case the response is favorable to your interests, you will be receiving it within the 10 following days; please note that these deadlines may be extended under the terms of article 32 of the LFPDPPP (Federal Law on Protection of Personal Data).

We do not omit to point out that You can revoke the consent you previously granted us at any time, for this purpose , you shall observe the procedure outlined in the previous paragraph.

USE OF COOKIES AND WEB BEACONS. When visiting our website www.losarbolitos.com.mx, you may find 'cookies' which are text files automatically downloaded and storaged in the hard drive of your computer equipment when surfing through the internet web page, which allow the server to record some of your data.

Additionally, web beacos can be found, that is, images inserted in the page, which can be used to monitor the behaviour of the person surfing the net, store information about the user's IP address, duration of the interaction in the site, the kind of web browser the user utilizes, etc. All the above can be disabled in the settings of the browser you are using.

USE OF SOCIAL NETWORKING SITES.

This company promotes its services by using assorted social netoworks, to this end, this means is used as a marketing tool and at the same time the client can interact directly with LOS ARBOLITOS or with other users as to inform them about our special promotions and offers.

Security and privacy locks are used on Facebook. If you do not wish to interact with us to the ends previously mentioned we ask you to state your objection before the Privacy Department.

LOS ARBOLITOS  employs adequate administrative, technical and physical measures, to protect your personal data from damage, loss, tampering, destruction, altering, or divulging, as well as access or handling by unauthrized third parties. In case an infringment occurs, we promise to make you aware by electronic and/or physical means in order to avoid an even more serious breach to your privacy.

In case of future amendments to this Privacy Notice, you will be notified via e-mail and/or through www.losarbolitos.com.mx, and/or any other oral, printed or electronic means regarded as suitable by LOS ARBOLITOS.
